1. Agreement to Terms

These Terms of Service are entered into by and between you and Sıradışı, registered at Ecdat Street 19-1, Eyüpsultan, Istanbul, Turkey. By accessing or using Sıradışı's services, you agree to be bound by these Terms of Service and our Privacy Policy and Refund Policy. If you disagree with any part of these terms, you may not access our services.

By completing a purchase, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Refund Policy.

At checkout, you must confirm acceptance of these Terms and our Refund Policy by selecting the consent checkbox.

2. Service Description

Sıradışı provides AI-powered custom animated short film creation services. We produce 1-2 minute animated videos based on your story, delivered as digital files according to the selected service tier (Starter, Standard, or Premium).

3. Digital Deliverables and License

The purchase results in delivery of digital video files in MP4 format (or other agreed formats). Upon full payment and project completion, you receive a non-exclusive, worldwide, perpetual license to use the final deliverables for your personal or commercial purposes, including but not limited to:

• Marketing and promotional materials
• Social media content
• Personal use and sharing
• Commercial presentations

This license does not include the right to resell, redistribute, or claim ownership of the animation as your own work. You may not sub-license the deliverables to third parties.

4. Payment Terms

All payments are processed by Paddle.com Market Limited (Paddle), acting as our Merchant of Record (MoR). By making a purchase, you agree to Paddle's terms and conditions. Taxes are calculated and collected by Paddle in accordance with applicable laws.

• Payment is required upfront before project commencement
• All prices are listed in EUR (Euro)
• Prices include applicable taxes as determined by Paddle
• Prices are subject to change with notice
• Payment confirmation and receipts are issued by Paddle

5. Project Timeline and Delivery

Our standard delivery timeline is same-day delivery via WhatsApp. After you complete the order form with your project details, our team begins work immediately and delivers your custom animated film within the same business day (typically within 24 hours).

Delivery times may vary based on order volume and project complexity. We will communicate any delays promptly and keep you updated throughout the process.

6. Character Accuracy and Expectations

Our AI-powered animation process creates characters inspired by the photos and details you provide. However, please note:

• Characters will NOT be 100% identical to real persons. We consider features like face shape, body type, hair color, and style, but exact replication is not expected or guaranteed.
• For best results, provide clear, well-lit photos without glasses, hats, or filters that obscure facial features.
• The more detailed your description of settings, clothing, seasons, and visual elements, the more personalized your animation will be.

7. Intellectual Property Rights

7.1 Your Rights

As stated in Section 3, upon full payment, you receive a non-exclusive, worldwide, perpetual license to use the final animated film for your intended purposes.

7.2 Our Rights

We retain the right to showcase your project in our portfolio and marketing materials unless you request otherwise. We retain ownership of templates, tools, AI models, and proprietary processes used in creation.

8. Client Responsibilities

You agree to:

• Provide accurate and complete project information
• Provide clear, high-quality photos for character creation
• Respond to requests for feedback in a timely manner
• Ensure content does not infringe on third-party rights
• Not use the film for illegal, harmful, or defamatory purposes

9. Prohibited Content

We reserve the right to refuse projects containing:

• Illegal, harmful, or discriminatory content
• Content that infringes intellectual property rights
• Adult or sexually explicit material
• Content promoting violence or hatred

Additionally, we do not produce face swaps, deepfake images/videos, or voice impersonations, and we will not create unlawful, infringing, or misleading likenesses.

10. Refund and Cancellation Policy

Please refer to our separate Refund Policy for detailed information about cancellations and refunds. By making a purchase, you acknowledge that you have read and agree to our Refund Policy.

11. Limitation of Liability

To the maximum extent permitted by law, Sıradışı shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability shall not exceed the amount you paid for the services.

12. Termination

We reserve the right to terminate or suspend service immediately, without prior notice, for conduct that violates these Terms or is harmful to other users, us, or third parties.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website with a new "Last Updated" date. Your continued use constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Turkey, without regard to conflict of law provisions.
